PRIVACY POLICY
Last update: August 11, 2026
Article 1: Data collection
Tennis & Biomécanique is committed to protecting the privacy of Users and Participants in accordance with applicable legal requirements, in particular Regulation (EU) No. 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “GDPR”), and French Law No. 78-17 of January 6, 1978 on information technology, data files, and civil liberties (the “French Data Protection Act”).
Tennis & Biomécanique is the only party that collects this data.
Tennis & Biomécanique collects data only when the user contacts T&B through the “contact form” available on the site.
This data is collected so that we can get back to users and offer them a service or information matching their request.
Users’ personal data is kept for 3 years.
The data that Tennis & Biomécanique needs to meet its contractual or legal obligations — accounting obligations in particular — is retained and deleted only at the end of the applicable statutory limitation period.
The User may, at any time, request to access, correct, and/or delete their data.
Article 2: Cookies
On arriving at the site, the User is informed via a banner that cookies may be installed automatically on their browsing software.
The User may choose to accept or decline them.
A cookie is an item that does not identify the User but serves to record information about their browsing on the website.
Article 3: Intellectual property and personal data regarding the video analysis service
3.1 – Video provided by the Client
The Client retains their rights in the source video. For the sole duration and solely for the needs of performing the contract, the Client grants the Provider a non-exclusive authorization to download, reproduce, view, annotate, and technically process the video. This authorization ends when the working copies are deleted, subject to legal retention obligations and the handling of any complaint.
3.2 – Analysis delivered to the Client
The methods, comments, annotations, diagrams, materials, and the contents of the explanatory discussions (in writing, by phone, or by video call) produced by Tennis & Biomécanique remain protected by intellectual property law. Payment grants the Client a personal, non-exclusive, non-transferable right to use the analysis for their own training. The Client may share it privately with their coach, their strength-and-conditioning trainer, or the healthcare professionals who support them. Any public disclosure, commercialization, substantial modification, or reuse for training or communication purposes requires the Provider’s prior written consent.
3.3 – Data processing
The data controller is the Provider identified in Article 1. The data that may be processed are the Client’s contact details, the order and payment information, the source video, the image and possibly the voice of the people filmed, the analysis produced, and the exchanges relating to the service.
This data is used to manage the order, verify payment, produce and deliver the analysis, issue the invoice, provide follow-up, and handle complaints. This processing is based on the performance of the contract and pre-contractual measures, on the Provider’s legal obligations, and, for the defense of its rights, on its legitimate interest. No marketing or promotional reuse of the video is based on acceptance of the Terms of Sale.
3.4 – Recipients and technical service providers
The data is accessible only to the Provider, to its authorized independent contributor if any, and to the strictly necessary technical service providers: payment (Stripe), site hosting, email, and — depending on the Client’s choice — an online transfer or storage service or WhatsApp. Each external service applies its own privacy policy and may carry out international data transfers under the safeguards it declares. The Client should review the terms of the service they choose to transmit the video.
3.5 – Retention periods
- the source video, the downloads, and the working copies are deleted no later than thirty days after the analysis is delivered, unless a complaint is pending, a legal obligation applies, or the Client has made a written request for later follow-up;
- the copy of the analysis kept by the Provider is deleted within the same period, unless it is needed as evidence in the event of a complaint;
- the data needed to prove the order and the contract may be archived for five years;
- invoices and accounting records are kept for ten years;
- data used for marketing purposes, only on an appropriate legal basis, is kept for the duration of the business relationship and then for a maximum of three years after its end or after the last relevant contact.
3.6 – Individuals’ rights
Any data subject has, under the conditions provided by the GDPR, rights of access, rectification, erasure, restriction, objection, and portability, as well as the right to withdraw their consent when a processing operation is based on it. Requests are sent to contact@tennis-biomeca.com or to the postal address in Article 1. Proof of identity may be requested in the event of reasonable doubt. The data subject may also file a complaint with the CNIL, the French data protection authority (www.cnil.fr).
3.7 – No reuse without a separate agreement
The video and the analysis are neither published nor used as an example, testimonial, training material, or communication content without prior, free, specific, informed, and separate consent, distinct from acceptance of the Terms of Sale. Refusing such use has no effect on the order. Any consent given may be withdrawn for the future.
